JUDGMENT : Plaintiff hit in intersection by delivery truck

On August 28, 1985 the Plaintiff, a 32-year-old factory foreman, was driving his car through a controlled intersection when he was broadsided by the Defendant’s delivery truck. The Plaintiff claimed the Defendant was negligent for running the red light. The only eyewitness to the accident confirmed the Plaintiff’s version of the accident.

The Defendant argued that the Plaintiff ran the red light and disputed the extent of the Plaintiff’s injuries.

The Plaintiff suffered a severe brain injury resulting in epilepsy and spastic quadriplegia. The initial cost of his medical care was $197,000 with an estimated lifetime amount of $5,410,478 in medical costs.

The trial lasted half a day.
