We’re Handling Defective E-Cigarette Lawsuits

While that may be true from the standpoint of avoiding lung cancer, e-cigarettes have introduced a new hazard, namely cheap, defective lithium-ion batteries that have a tendency to explode. We just wrapped up a case on behalf of a gentleman who experienced such an explosion while he was driving, causing severe burning of his hand and abdomen. There have been a number of similar incidents across the country.

These batteries and the “vaping” devices themselves are often manufactured in China, by companies over which it is difficult to establish jurisdiction in the United States. The challenge then becomes finding a U.S. company that was involved in the distribution or retail sale of the product and that has significant insurance coverage and/or assets. Under strict liability law, any such company that was in the “chain of distribution” of the product can be held liable for all of the plaintiff’s damages.
