CPS Liability
Every county in California has a child protective services (“CPS”) department. These agencies’ only purpose is to protect children from serious abuse and neglect. When a concerned citizen contacts CPS to report that a child is being mistreated, it is up to a CPS social worker to conduct a prompt and thorough investigation, determine whether abuse or neglect is in fact occurring and take any needed steps to protect the child from further harm.
Many CPS social workers are hard-working and committed to protecting children. However, we have come across too many cases where social workers have failed to take action in the face of obvious mistreatment of a child. This has resulted in children being killed, raped and suffering catastrophic injuries such as a brain damage and paralysis.
There are laws that set forth the steps that social workers must take when investigating child abuse and neglect. When they choose not to take those steps, they can be held liable for the harm that they have caused.
You need a lawyer with the compassion and drive to win a lawsuit against CPS.
Our firm has had more success over the past decade than any other firm in California in bringing these very challenging cases. We have obtained much needed financial compensation for the children whom we have represented, which has enabled them to get the care they need to start to put their lives back together and repair the immense harm that they have suffered. We have held both counties and private foster care agencies responsible, which has encouraged them to change their practices so that children are better protected in the future.
If you aren't sure what to expect, or are unsure taking legal action is right for you, here are a few clients we have successfully represented in sexual abuse and physical abuse cases:
Settlements and Verdicts in CPS Eligibility.
- Plaintiff was severely abused and tortured at the hands of his father's girlfriend for a period of approximately eight months when he was four years old. As a result of his injuries, child was left paralyzed on the left side of his body, non-verbal, and G-tube dependent for food.
A teenage girl was raped and kidnapped by her mother’s boyfriend.
- Turpin siblings (13 children) were exposed to violence, deprivation of food, sleep, proper hygiene, education, and medical care. Then for the six minors, at least, the County and a private foster family agency (ChildNet) placed them with foster parents who had a history of abuse and neglect.

- Plaintiff was forced by her father to watch and participate in the torture of her brother, which eventually lead to his death, and child protective services failed to intervene.
In each of these cases, we obtained settlements that allowed the victims to get the psychological counseling and other help that they needed in order to try to put these terrible incidents behind them.
